Terms and Conditions

These Terms & Conditions (“Terms”) govern your use of thebuzz.network, our web player, and our iOS and Android mobile apps (together, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1) Who we are and how to contact us

The Services are operated by Kooky Inc Ltd, trading as The Buzz Network / The Buzz (“we”, “us”, “our”).

2) What the Services provide

The Services allow you to listen to our live radio streams and, where available, access community features such as accounts, profiles, favourites and “Moments”. We may change, update, suspend or withdraw any part of the Services at any time.

3) Eligibility and age

The interactive parts of the Services (including creating an account and sharing Moments) are intended for users aged 16+.

If you are under 16, you must not create an account or submit any content.
If you are a parent/guardian and you believe a child has provided personal data or created an account, please contact us.

4) Accounts and guest access

You may be able to use parts of the Services without an account (“guest mode”). Some features may require an account.

If you create an account, you agree to:

provide accurate information;
keep your login details secure and confidential;
notify us promptly if you suspect unauthorised use of your account.
We may suspend or terminate accounts where we reasonably believe there has been misuse, a breach of these Terms, or risk to users or the Services.

5) Your licence to use the Services

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Services for lawful, non-commercial purposes, subject to these Terms.

You must not:

copy, modify, reverse engineer, decompile, or attempt to extract source code from the Services (except to the extent the law permits);
interfere with, damage, or disrupt the Services (including introducing malware or attempting unauthorised access);
scrape, harvest or collect data from the Services in an automated way without our permission.

6) Acceptable use (community rules)

You must not use the Services to do anything illegal, harmful, abusive or offensive.

This includes (without limitation):

harassment, bullying, hate speech, threats, or incitement to violence;
impersonation or misleading others about who you are;
posting or sharing content that is defamatory, obscene, or otherwise unlawful;
sharing personal information about someone else without their permission;
spam, scams, or fraudulent activity.

7) User content: “Moments”

A Moment is user content that can include:

an emoji to represent an emotion; and
an optional text note and/or an optional voice note.

There is no public commenting, direct messaging, or real-time chat.

7.1 You are responsible for what you share

You are responsible for your Moments and you confirm that:

you have the right to submit them;
they do not infringe anyone else’s rights;
they comply with these Terms.

7.2 Where Moments may appear

Moments are designed to be shared through the Services. Depending on how we present features at the time, your Moment may be visible to other users of the Services.

7.3 Licence you grant to us

When you submit a Moment, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, modify (for formatting and moderation), publish, display and distribute your Moment as needed to operate, promote and improve the Services.

7.4 Broadcast (“on-air”) use of Moments

By submitting a Moment, you agree that we may (at our discretion) select it to be featured by The Buzz, including by playing a voice note on-air or referencing a text note.

8) Moderation, reporting and enforcement

We want the Services to be safe and enjoyable.

8.1 Reporting

We provide a “Report Moment” feature (flag icon). Moments are the only user content that can include text or voice notes.

We review all reports within 48 hours.

If you need to report an urgent issue or cannot access the reporting feature, contact us at hello@thebuzz.network.

8.2 Our actions

We may remove or restrict access to any Moment, and/or suspend or terminate an account, where we reasonably believe:

these Terms have been breached;
content is objectionable, harmful or unlawful; or
action is necessary to protect users, the Services, or comply with legal obligations.

9) Intellectual property

All rights in the Services (including software, branding, logos, design and editorial content) belong to us or our licensors.
Music, artwork, artist names/logos and related content remain the property of their respective owners and licensors. You must not use or reproduce them except through normal use of the Services.

10) Streaming availability and charges

Live streaming depends on network connectivity and third-party infrastructure. We do not guarantee uninterrupted availability.
You are responsible for any internet or mobile data charges incurred when using the Services.

11) Competitions, promotions and giveaways

From time to time we may run competitions, promotions or giveaways.

Any such activity will be subject to separate competition terms (for example, eligibility, how to enter, prizes, and how winners are chosen).
Where competition terms conflict with these Terms, the competition terms will apply for that competition.

12) Privacy

Our Privacy Policy explains how we collect and use personal data when you use the Services.

13) Third-party services and app stores

The Services may rely on third-party platforms and services (for example Apple, Google, streaming providers, analytics, or notification providers). Those services are governed by their own terms and policies.

If you download our app from the Apple App Store or Google Play, your use may also be subject to their terms and policies.

14) Disclaimers

The Services are provided on an “as is” and “as available” basis.

Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or fraud.

15) Limitation of liability

To the fullest extent permitted by law:

we are not liable for indirect or consequential losses, loss of profits, loss of data, or loss of goodwill; and
our total liability to you for all claims relating to the Services is limited to the amount you paid us for the Services in the 12 months before the event giving rise to the claim (or £0 if you have not paid us).

16) Termination

You may stop using the Services at any time.

We may suspend or terminate your access (including any account) if you breach these Terms, or if we reasonably believe doing so is necessary to protect users, protect the Services, or comply with law.

17) Changes to these Terms

We may update these Terms from time to time. We will post the latest version on thebuzz.network and update the “Last updated” date. Continued use of the Services after changes means you accept the updated Terms.

18) Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except where consumer protection laws require otherwise.
